Changes to the Terms and Conditions

TOPSPA reserves the right to modify these Terms and Conditions at any time. Any changes will be posted on the website, and users will be notified by email. Continued use of the services after such changes constitutes acceptance of the new Terms and Conditions.


Introduction

Purchasing e-vouchers through the online store www.topspa.pt/en implies the customer’s acceptance of the General Terms of Sale in compliance with the applicable legislation for e-commerce. The purchase process is only possible after creating a customer account and logging into the online store.


About the E-Voucher

  • All massages, treatments, and/or rituals purchased through the website come with an associated e-voucher. Both the services and the corresponding e-voucher are listed on the www.topspa.pt/en website, which is regularly updated.
  • The e-voucher grants access to the specific service chosen by the buyer and provided by TOPSPA when purchased through the website www.topspa.pt/en. To complete the purchase, the buyer must access the store.

Physical e-vouchers are labeled "Voucher" and can be used at any spa managed by TOPSPA for their purchase value. However, they are not available online and cannot be used at other points of sale.are not available online and cannot be used at other points of sale.

 

Validity and Renewal

  • The e-voucher associated with massages/treatments and/or rituals is valid for one year. The service must be used within this period, or the rights granted by the e-voucher will be irrevocably lost after expiration.
  • Customers should retain proof of payment of the e-voucher during its validity period to allow TOPSPA to resolve any activation-related issues. Without these documents, TOPSPA will not be able to address potential problems or identify the associated purchase.
  • It is not possible to renew or extend the validity of the e-voucher after it has expired, resulting in its automatic cancellation and the forfeiture of all usage rights.

 

Exchanges

  • During its validity, the e-voucher can be exchanged free of charge, without limitation on the number of times, as long as the new service does not exceed the original value. If the new service exceeds the value of the e-voucher, the bearer must pay the difference at the time of the service.
  • E-voucher exchanges are handled directly by the respective spa. To make an exchange, the customer must contact the spa by phone or visit in person.
  • In the event of non-use, loss, theft, or destruction of the e-voucher, the bearer or purchaser is not entitled to any compensation or use of the voucher.
  • Spa changes are permitted provided that the new spa is owned and managed by TOPSPA. To make the change, the customer must contact the chosen spa by phone or email and request the booking of the same or equivalent service. Each spa has its own pricing structure, and the same service may have a different price at different spas. If the new price exceeds the value of the purchased e-voucher, the bearer is responsible for paying the difference.

 

Cancellation and Booking

  • If a customer wishes to cancel or change a booking made with an e-voucher, this must be done directly with the respective spa, following TOPSPA's commercial policy, with a minimum of 8 hours notice before the service starts time.
  • Cancellations that do not comply with the above terms will not be processed, and the rights associated with the e-voucher, including rescheduling, will be lost.
  • If the bearer fails to attend the appointment without canceling or rescheduling as described above, all rights related to the e-voucher, including rescheduling or renewal, will be forfeited.

 

Pricing and Payment

All prices on the TOPSPA website include VAT at the applicable rate. Accepted payment methods are specified during the checkout process. TOPSPA makes every effort to ensure the accuracy of the prices on the website but reserves the right to correct any errors that may occur.
 

Restrictions

  • Services may require the verification of certain conditions and requirements, such as minimum age, health status, physical or psychological conditions, or other criteria.
  • Booking restrictions are established by TOPSPA, and the company is responsible for managing reservations and informing e-voucher holders via the website www.topspa.pt/en.
  • Any physical and/or mental limitations must be explicitly communicated to the therapists at the spa or directly to TOPSPA, as failure to do so may prevent the experience from taking place.
     

TOPSPA Responsibility

TOPSPA is responsible for the organization, execution (except for delays attributable to customers), provision, and delivery of massages/treatments and/or rituals, including scheduling, cancellation, or postponement. TOPSPA is also responsible for all issues related to non-performance or poor performance of services, as well as any other circumstances directly or indirectly related to the services provided.
 

Suggestions and Complaints

Customers have the right to submit complaints either through the Complaints Book or directly to the regulatory authorities. Customers can also submit suggestions via email to online.store@topspa.pt.


Consumer Dispute Resolution

In the event of a consumer dispute, as defined by Law No. 144/2015 of September 8, as amended, the consumer may contact the appropriate alternative dispute resolution entity. An updated list of all available entities can be found at www.consumidor.pt.

If no entity is competent to resolve the dispute, the consumer may contact the National Centre for Information and Arbitration of Consumer Conflicts in Lisbon via email at geral@cniacc.pt or by visiting www.cniacc.pt/pt/apresentacao-de-reclamacao.

 

Right of Withdrawal – Applicable to distance sales via the TOPSPA website

When purchasing an e-voucher exclusively from the website www.topspa.pt/en, the customer has the right to withdraw from the purchase within 60 days from the date of receiving the e-voucher, provided the service has not yet been performed.

To exercise the right of withdrawal, customers must communicate their decision via an unequivocal statement (e.g., a letter sent by mail or email). The statement should be sent to:

TOPSPA holds exclusive intellectual property rights over all content represented on the e-voucher and in the presentation and experience catalog on the website www.topspa.pt, including copyright, trademarks, logos, and design elements (text, images, software, web design, etc.).

The customer agrees to fully respect these rights and to refrain from engaging in any act that may infringe upon them.

Nothing in these Terms and Conditions shall be construed as granting a license to use any of the mentioned intellectual property rights.
